Bringing a Relative to the United States

The quickest family-based method of immigration is through a petition filed by an immediate relative. For your relative to sponsor you, they must meet specific criteria.

  • They must be a documented U.S. citizen.
  • They must prove they can financially support you at 125% above the current poverty level.
  • They must by able to provide proof of your relationship.

The relatives that may be sponsored by a U.S. Citizen are:

  • Spouse (spouse or fiancée visa)
  • Unmarried child of any age (children's visa)
  • Married child of any age
  • Sibling (sponsor is at least 21)
  • Parent (sponsor is at least 21)

The relatives that may be sponsored by a lawful permanent resident include:

  • Unmarried child less than 21 years old
  • Spouse

Family-Sponsored Preference Categories

If you chose to come to the United States through family immigration, you must obtain an immigrant visa number. Potential immigrants are classified into categories based on a preference system. This determines whether or not you will have to wait for your visa number. To find out which priority dates are current please check the Visa Bulletin.

The parents, spouses and unmarried children (under age 21) of a citizen do not have to wait for a number. Individuals in the remaining categories must wait for an available visa number according to preferences.

First Preference: Unmarried adult children of U.S. citizens.

Second Preference: Spouses and unmarried children (under 21) of lawful permanent residents

Third Preference: Married children of citizens.

Fourth Preference: Siblings of adult citizens.
