Visas and Certifications

Our principal attorney Ricky Malik aids employers and employees in securing a variety of employment visas and certifications.

  • H-1B: This specialty occupation visa is valid for three years and renewable for another three. It pertains to professionals with at least a baccalaureate degree and specialized knowledge. In order to petition for a H-1B, a company must first obtain a Labor Condition Application (LCA) petitioning for a prevailing wage and submitting to the Department of Labor (DOL).
  • H-2a and H-2b Visas: Temporary visas allowing for seasonal workers.
  • Labor Certifications: Employers may petition the DOL for visas if a shortage of citizen workers exists. A permanent labor certification allows for permanent hire of a foreign worker.
  • Investor Visa: Provides opportunity to start or take over a U.S. business. Visas can be an E-2 (non-permanent) or a green card which allows Lawful Permanent Residence (LPR).
  • Business Visa (B-1): Applies to a temporary, legitimate business visit.
  • Inter-Company Transfer Visas (E/L): Arise when a company has branches in multiple countries and employee will work at one of those offices.
  • TN-1: Applies to Canadian NAFTA professional.

Employer Compliance

Employment Based Preference Categories

If you chose to come to the United States through employment immigration, you must obtain an immigrant visa number. Potential immigrants are classified into categories based on a preference system.
